Chapter Bylaws of the Misted Hills Chapter
of Eldaraenth Larp
Article I: Name and Purpose
Section One: Name.
The Chapter of Eldaraenth LARP promoting gameplay in and around the area of Springfield, Missouri shall be known as The Misted Hills. The name was founded in 1998 to identify the Springfield area chapter’s activities and involvement within the game and has been carried through to the current game incarnation.
Section Two: Purpose.
The purpose of The Misted Hills is to provide members with a representation of the game, Eldaraenth LARP, (Hereafter referred to as Eldaraenth) and to adhere to the rules and guidelines of said game. The Misted Hills will strive to provide fun and entertainment to all members. Members representing The Misted Hills are expected to conduct themselves in a knightly manner when representing the organization in public, to adhere to the rules and conduct as specified in all Eldaraenth gameplay documentation, and to have the highest regards for members of other chapters at official gatherings or events and for the community at large.
Section Three: The Golden Rule.
All members of The Misted Hills will understand that business outside of this organization will be primary over this organization. Should a member be unable to attend events, practices, or other official gatherings sanctioned by The Misted Hills or by Eldaraenth LARP because of mundane business, it will not be detrimental to the development of that person as a member of The Misted Hills, nor shall it cause consequences to the development of their character above or beyond those implied by the rules of Eldaraenth. Any personal business shall come first over this organization.
Article II: Membership
Section One: Requirements.
To become a member of The Misted Hills, one must first attend one meeting of The Misted Hill's council before their first event. If this is not possible, they must meet with one of the members of the council so they may have a comprehension of what Eldaraenth is and what will be expected of them at events and when representing the organization and chapter.
They player must then then create their character by providing a brief character history and have it submitted to the local president for eventual submission to the official records along with the waiver of liabilities prior their first event.
If a player does not attend any gathering sanctioned by Eldaraenth for a period of two months, that player is considered inactive. Inactive players that remain inactive for a period exceeding six months will be considered defunct and will no longer be considered as a part of the chapter’s standing membership.
Article III: The Misted Hills Council
Section One: Definition and Purpose.
The chapter of the Misted Hills will function as a republic. Representatives will be elected from the populace of active players to represent the player’s interests in governing the chapter as a whole. The council members are a representation of the members of The Misted Hills. They reflect the views and concerns of the chapter as a whole on a national level and bring those concerns to the awareness of the national committee or other national ruling body.
The primary purpose of the council is to make sure that every member of The Misted Hills is upholding the rules and bylaws of Eldaraenth and The Misted Hills. They are the law enforcers of the chapter and reserve the right to rule on disputes between players, interpret game rules for play at sanctioned events, and perform other official duties as required or as provided for within these bylaws.
The secondary purpose of the council is to carry out the functions of presenting the game to the players. The council is charged with the forming of committees to plan and carry out events run under the Eldaraenth rules. The council will be responsible for assuring that all events are carried out following the spirit of Eldaraenth national rules, and adhering to any existing national storylines.
The council is trusted to carry out the wishes and demands of the members as long as they are both within the guidelines of the bylaws of Eldaraenth and The Misted Hills and in the best interest of the game and its players. The council will not carry out any requests made by the members if those requests are in violation of those rules.
Section Two: Members.
Council membership shall consist of a President (Regent), Combat Marshal (High Marshal), and Story Marshal (Storyteller) elected by popular vote of the active members. Additional offices may be added as deemed necessary based upon growing responsibilities and membership of The Misted Hills chapter.
Section Three: Eligibility.
Each member of the council must have been an active member in Eldaraenth for over 1 year. In that year the member must have been a member of the Misted Hills chapter of Eldaraenth for a period of no less than six consecutive months prior to obtaining the post.
Section Four: Terms.
Terms of officers are 2 year elected terms which begins on January 1st and ending on December 31st of the second year. Members may opt to seek successive terms without limitation.
Section Five: Responsibilities.
The council is the overall governing body of Misted Hills. All final decisions on Eldaraenth business pertaining to members of the Misted Hills chapter are made here.
Each member must be knowledgeable of the currently sanctioned rulebook and any modifications or errata that have been sanctioned since initial publication and are responsible for carrying out these rules and regulations.
The council coordinates efforts of hosting events with local committees and members as well as with the head storytellers of the national committee or current governing organization of Eldaraenth LARP. Secures resources needed for hosting or organizing events or other official gatherings under the Eldaraenth rules in the area in and around Springfield, Missouri.
The council is responsible for approval of a new member’s character.
The council may form and assign members to special committees as needed.
The council is responsible for promoting people to marshal status as needed by the growth of the chapter and as dictated by Eldaraenth rules.
During the course of an officer's term, if they choose to step down from that office or are removed from their office due to inactivity within the game, than the remaining council will appoint a replacement based on the suggestions of the previous officer and the players.
Article IV: Officers
Section One: President.
Subsection 1: Title
The President of the Council of the Misted Hills will be referred to by title as Regent.
Subsection 2: Role
The duties of the chapter Regent include overseeing meetings of the council members, and scheduling said meetings to occur on a basis of no less than once each calendar month.
The Regent serves as mediator and holds power of resolution in disputes between marshals and combatants, and between elected members of the council.
The Regent is responsible for final submission for eventual publication any official records of events, new or returning members, inactive or defunct members, or changes in chapter status.
The Regent acts as the voice of The Misted Hills in meetings with other chapters and, or the governing body of the game as a whole.
The Regent serves as the chapter’s Treasurer in absence of an elected official. To such ends the Regent’s name shall be included on any account held in the name of the Misted Hills chapter.
Section Two: Vice President.
Subsection 1: Title
The Vice President of the Council of the Misted Hills will be referred to by title as Viceroy.
Subsection 2: Role
The office of Viceroy shall only be called into election if the active membership of the Misted Hills Chapter is greater than fifteen members for no less than three consecutive months prior to the date of general elections in a given year. If chapter size dictates that no Viceroy be elected all duties of the Viceroy fall to the Chapter’s Regent to be carried out.
The Viceroy acts in the role of Regent in absence of an elected Regent at meetings of the council or national functions.
The Viceroy is charged with maintaining order and retaining records of minutes at official meetings of the Misted Hills Council.
The Viceroy shall organize committees based upon need, council recommendation, or members’ recommendation; and acts as a intermediary between members of the council and said committees.
Section Three: Treasurer:
Subsection 1: Title
The Treasurer of the Council of the Misted Hills will be referred to by title as Treasurer.
Subsection 2: Role
The office of Treasurer shall only be called into election if the active membership of the Misted Hills Chapter is greater than fifteen members for no less than three consecutive months prior to the date of general elections in a given year, or if the sum of any accounts held by the chapter total in excess of $500. If chapter size or funding dictates that no Treasurer be elected all duties of the Treasurer fall to the Chapter’s Regent to be carried out.
The Treasurer is in charge of accounting for The Misted Hills’ assets and money.
The Treasurer works with the council to determine how funds shall be disbursed based upon the needs of the chapter and member votes. To such ends the Treasurer’s name shall be included on any account held in the name of the Misted Hills chapter.
The Treasurer is responsible for providing monthly reports of financial status to the council and members at each meeting of the council.
The Treasurer is responsible for heading any fund raising efforts unless otherwise specified.
Section Four: Story Marshal.
Subsection 1: Title
The Story Marshal of the Council of the Misted Hills will be referred to by title as Storyteller.
Subsection 2: Role
The Storyteller is responsible for maintaining character records for members of The Misted Hills chapter of Eldaraenth.
The Storyteller works with the Regent and High Marshal to plan and prepare events and fighter practices as well as maintain the over-all story line of the Misted Hills.
The Storyteller is responsible for mediating disputes between players involving meta-game, or out-of-character, knowledge used in furthering in-character role-play.
The Storyteller is responsible for ensuring that all activities within the chapter of The Misted Hills adhere to established national storylines.
Section Five: Head Combat Marshal.
Subsection 1: Title
The Head Combat Marshal of the Council of the Misted Hills will be referred to by title as High Marshal.
Subsection 2: Role
It is the duty of the High Marshal to ensure that all activities sponsored by the Misted Hills meet or exceeded the safety standards endorsed by Eldaraenth LARP.
The High Marshal is responsible for organizing fighter practice for combatant members of the Misted Hills.
The High Marshal is responsible for training and authorizing combat marshals as set forth in the Eldaraenth rules and bylaws.
The High Marshal is responsible for ensuring that combat authorizations for all members of the Misted Hills chapter indicate an exceptional level of safety, control, and preparation, and meet or exceed the highest possible standards for honourable combat.
Article V: Expansion of Council Membership
Section One: Officers.
As the chapter of The Misted Hills grows in population, new seats on the council may be added to better represent the chapter as a whole and to take on the new responsibilities of a bigger chapter.
The addition of new officers to the council shall be ratified by amendment of the chapter bylaws as set forth in Article X.
Section Two: Representatives.
Subsection 1: Requisites
The membership at large may request that additional representative seats be made available on the council based upon the size of the active membership of chapter.
Nomination for addition of representative positions to the council may be made by official request to the existing council at any time, with the vote for ratification of the addition of representative seats to take place no more than one month (30 days) following the request.
Addition of representative seats must be ratified by vote of a ¾ majority of active members of the chapter.
No more than one representative seat on the council may be created for every ten active members of the chapter, rounding down. Should the number of active members in the chapter fall below the number needed to maintain the current representative seats for a period of three consecutive months those seats will be revoked, proceeding in reverse order of their creation.
Subsection 2: Title
Representatives of the Council of the Misted Hills will be referred to by title as Councilman.
Subsection 3: Role
It is the duty of the Councilman to represent the wishes of the population of the membership of the Misted Hills chapter at meetings of the Council of the Misted Hills.
A councilman shall be afforded the same vote as an officer for the sake of votes among members of the council.
Subsection 4: Term
Unlike officers, a Councilman serves a term of one year.
Should a Councilman be voted into office at a time not corresponding to general elections the position will be open to nomination during general elections of the same year.
Article VI: Elections and Impeachment
Section One: Frequency.
Subsection 1: General Election
General elections shall be held on the first weekend in December of each year, given that offices are available to be filled. Nominations for offices take place no less than one month (30 days) prior to the election date.
Subsection 2: Emergency Election
An emergency election may be called by any active member of the chapter in the event that the position of an officer within the council becomes open due to abdication or impeachment. Nominations for offices will be taken for a period of two weeks (14 days) prior to the date of emergency election and may continue until the day of the election.
Section Two: Voting.
Members, who cannot be present at the time of elections, may still submit their vote. Absentee votes must be made no more than one week (seven days) prior to the day of the election. The current Viceroy shall be responsible for collecting those votes prior to the elections. These votes must be sealed in an envelope until the day of the elections.
Voting at the general election will be performed utilizing a closed ballot system, and votes will be tallied publicly by the chapter’s Viceroy.
A simple majority is required to decide the winners of the election.
Section Three: Eligibility.
Eligible voters are defined as active members of the Misted Hills chapter of Eldaraenth above the age of 10 years, or any active member of the Misted Hills that has maintained an active membership for a period of six consecutive months prior to the day of the general election.
Section four: Abdication and Impeachment.
Subsection 1: Abdication
Should an elected member of The Misted Hills Council no longer be willing or able to perform the duties required by the position they may freely abdicate the position.
A player who abdicates an officer position may not offer themselves for re-election to the same position for a period of one year following the date on which their abdication takes effect.
An officer is considered to have involuntarily abdicated the position should the player become inactive.
Subsection 2: Impeachment
Any officer or representative member of the council may be called to be impeached by any active member of the chapter.
An officer or representative member of the council may be impeached by a unanimous vote of the remaining members of the council.
An officer or representative member of the council may be impeached by a 2/3 majority vote of all active members of the chapter.
Article VII: Ammendment of Bylaws
Section One: Definition.
Due to the fact that the creators of the bylaws cannot anticipate the changing needs of the growing chapter of The Misted Hills or Eldaraenth LARP, amendments to these bylaws may become necessary.
An amendment is a change or addition to the bylaws that maintains the standards and expectations of Eldaraenth LARP and gives the flexibility needed by the Misted Hills to make changes as the needs of the chapter change.
Section One: Process.
If there has been a change in the rules or regulations of Eldaraenth LARP or there is need for a change based upon the needs of The Misted Hills chapter, a proposal for amendment must be brought before the council.
The council will determine the validity of the proposed amendment and will format and present the amendment to the membership of the chapter should it be deemed appropriate.
Popular vote to ratify the proposed amendment will take place two weeks (14 days) following the presentation of the amendment to the populace.
A ¾ majority vote is required for ratification of an amendment.
If an amendment is ratified by popular vote the amendment shall be added to Article VIII exactly as it was proposed before the members.
